What does this mean?

Sellers are obligated to guarantee consumers that their products comply with the relevant purchase contract at the time of purchase. This warranty expires two years after delivery of the purchased item.

If you are a “consumer” according to Section 13 of the German Civil Code (BGB) and your device has a defect that already existed at the time of delivery and this defect is discovered within two years of delivery of the product, you are entitled to:

To request the repair or replacement of the product free of charge within a reasonable time and without significant inconvenience to you.

or

To demand a reasonable price reduction or termination of the contract if the product cannot be repaired or replaced.

or

if the repair or replacement of the product cannot be carried out within a reasonable time and without significant inconvenience to you.

    You can assert these rights against the seller from whom you purchased your product.

    Subject to proof to the contrary, any lack of conformity discovered within six months of delivery of the product must be presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the product or the nature of the lack of conformity.

    What is the difference between statutory liability for material defects and commercial or manufacturer's guarantees?

    A commercial warranty, such as the HyperX Manufacturer's Warranty, is a warranty voluntarily provided by the warrantor (either the seller or the manufacturer). The commercial warranty may have a different duration and cover different defects than the statutory warranty, and typically (as in the case of the HyperX Manufacturer's Warranty), you do not have to prove that the defect already existed at the time of delivery.

    The commercial guarantee does not replace or limit your consumer rights arising from statutory liability for material defects.

    Consequently, the manufacturer's warranty provided by HyperX for your HyperX product is independent of and in addition to any statutory warranty. The latter is legally available to you against your seller under the purchase contract for your HyperX product and remains unaffected by the HyperX manufacturer's warranty.
